  1. [1] INTRODUCTION
    1. (a)This Privacy Policy explains which information JawaSol Sdn Bhd (Registration No. 202401048922 (1594767-K)) ("we", "us", or "our") collects, how we use it, and the circumstances under which we may share it. This Policy applies to all websites, mobile applications, and online services operated by us (collectively referred to as the "Platform"), including MyCleanerHub.my and the MyCleanerHub app. JawaSol Sdn Bhd is the legal operator of the Platform. This Privacy Policy applies only to information collected through our Platform and does not apply to information collected offline or through other means. By using the Services, registering for an account with us, visiting our Platform, or accessing the Services, you acknowledge and agree that you accept the practices, requirements, and/or policies outlined in this Privacy Policy, and you hereby consent to us collecting, using, disclosing and/or processing your personal data as described herein. IF YOU DO NOT CONSENT TO THE PROCESSING OF YOUR PERSONAL DATA AS DESCRIBED IN THIS PRIVACY POLICY, PLEASE DO NOT USE OUR SERVICES OR ACCESS OUR PLATFORM. If we change our Privacy Policy, we will notify you including by posting those changes or the amended Privacy Policy on our Platform. We reserve the right to amend this Privacy Policy at any time. To the fullest extent permissible under applicable law, your continued use of the Services or Platform, including placing of any orders, shall constitute your acknowledgment and acceptance of the changes made to this Privacy Policy.
    2. (b)This Policy applies in conjunction with other notices, contractual clauses, consent clauses that apply in relation to the collection, storage, use, disclosure and/or processing of your personal data by us and is not intended to override those notices or clauses unless we state expressly otherwise.
    3. (c)Definitions and Interpretations
      1. [(i)]"Customer" refers to any individual and / or entity seeking a cleaning service.
      2. [(ii)]"Service Provider" refers to any individual and / or entity offering cleaning services.
      3. [(iii)]"User" refers to any individual and / or entity that registers for an account on our Platform, including both Customers and Service Providers.
      4. [(iv)]"Post" refers to a service request created by a Customer, which is visible to Service Providers and includes information such as, but not limited to, the type of service, preferred schedule, required equipment, location, and any additional details, such as the presence of pets or preferred language.
      5. [(v)]"Services" refers to the Platform and the services we provide as described on our Platform.
      6. [(vi)]"Personal Data" or "Data" refers means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which an organization has or is likely to have access. Common examples of personal data could include name, identification number and contact information

    1. (a)Information You Provide
      1. [(i)]We collect your Data when you register, setup your profile, create a Post, or interact with other features on the Platform. This may include, but is not limited to, your name, email addresses, physical addresses, demographic information (e.g. birthdate, gender), ratings, reviews, communication history, User preferences, photos, details about your premises to clean (e.g. size, number of rooms, condition, access instructions, restrictions), and any other details required to process your requests or provide services through the Platform.
      2. [(ii)]Please note that the list provided is not exhaustive, and additional information may be collected as needed to offer our services or comply with applicable laws. You are not required to provide us with such information, but certain features of the Platform may not be accessible or available, absent the provision of the requested information.
    2. (b)Information You Provide
      1. [(i)]We may gather information about you or others from third-party sources to enhance fraud protection and safety measures, in accordance with applicable laws. This data may be combined with information we gather directly from you through the Platform.
      2. [(ii)]We may also collect details from third parties to ensuring the correct application of fees and enforcing our Terms of Service.
    3. (c)Automatically Collected Information
      1. When you access, browse, or interact with the Platform, we collect various types of information. This includes your communications with other Users, searches, pages viewed, and actions such as clicks. We also capture details like your IP address, geo-location, operating system, session duration, language preferences, and browser information, along with data from cookies and similar technologies.
    4. (d)Sensitive Personal Data
      1. Some of the Data that we collect may be sensitive in nature in certain jurisdictions. This may include Personal Data pertaining to your race, national ID information, religious beliefs, background information (including financial and criminal records, where legally permissible), health data, disability, marital status, location and biometric data, as applicable. We collect sensitive Personal Data only with your consent and/or in strict compliance with applicable laws. In the event that you are required to furnish any documentation or information to us for any purpose which may contain such sensitive Personal Data, you agree to redact such sensitive Personal Data before providing such documentation or information to us.
  3. [3] HOW WE USE COLLECTED DATA
    1. Your Data will be used to provide, personalize, maintain and improve our Platform and Services. This includes using your Data:
      1. (a)to deliver quality service, ensure security, and manage the Platform, including setting up accounts, handling password resets, tracking activities, facilitating communication, and providing customer support;
      2. (b)to maintain a secure Platform, prevent fraud, and protect Users by monitoring activities, assessing security risks, verifying details, investigating complaints, and enforcing our Terms of Service. We may limit access if suspicious activity is detected. Disputes can be addressed by contacting us;
      3. (c)to contact you as requested or permitted by this Policy;
      4. (d)to display certain profile information, such as, but not limited to, your name and ratings, your approximate location and premises information to other Users;
      5. (e)to manage billing and payment, including sharing data with third-party payment gateways and accounting systems;
      6. (f)to promote the Platform and services, including marketing communications, relevant content, and organizing promotional events like referral programs. If you wish to unsubscribe to the receiving of such marketing communications, please click on the unsubscribe link in the relevant email or message. Alternatively, you may also update your preferences in our App settings;
      7. (g)to maintain business records, resolve disputes, protect Users, fulfill lawful requests, and comply with applicable laws;
      8. (h)to provide and operate our Platform and services;
      9. (i)to perform internal operations necessary to provide our Services, including troubleshooting software bugs and operational problems, conducting data analysis, testing and research, monitoring and analyzing usage and activity trends;
      10. (j)to protect the security or integrity of the Platform and any facilities or equipment used to make the Platform available;
      11. (k)to invite you to participate in our events, surveys and studies;
      12. (l)for testing, research, analysis, machine learning, and product development. This allows us to understand and analyze your needs and preferences, protect your Data, improve and enhance the safety and security of our Services and Platform, develop new features, products and services, and facilitate development of any future feature for the Platform; and
      13. (m)when we are required, advised, recommended, expected or requested to do so by our legal advisors or any local or foreign legal, regulatory, governmental or other authority, including but not limited to, complying with court orders, or other legal, governmental or regulatory requirements, to enforce our Terms of Service or other agreements, and protect our rights in the event of a dispute.
      In providing you with these services and features, we may use manual or automated means, including AI services. We strive to ensure the accuracy and reliability of our AI-services, and whenever necessary, we may manually verify the outputs.
  4. [4] DATA RETENTION
    1. We follow the principle of retaining personal data only for as long as necessary to fulfill the specific purpose for which it was collected. However, in certain cases, we may retain your information for a longer period, including but not limited to the following scenarios:
      1. (a)To ensure we have an accurate record of our interactions in the event of disputes or complaints.
      2. (b)For data related to closed accounts, in order to comply with legal requirements, prevent fraudulent activities, collect outstanding fees, resolve any issues, support investigations, enforce our Terms of Service, and take any other actions allowed by law.
      3. (c)To meet statutory or other legal obligations to which we are subject.
      4. (d)To preserve necessary information for the purposes of legal action within applicable time limitations.
      Once your Personal Data is no longer necessary for the Services, or we no longer have a legal or business purpose for retaining your Personal Data, we shall take reasonable steps to erase, destroy, anonymize or prevent access or use of such Personal Data for any purpose other than compliance with this Policy, or for purposes of safety, security, fraud prevention and detection, in accordance with the requirements of applicable laws.
  5. [5] CHILDREN/MINORS
    1. This Platform is intended solely for individuals who are at least 18 years old and of legal age to form a binding contract. We do not knowingly collect or maintain any personal information from individuals under the age of 18. If we become aware that we have inadvertently collected personal information from a minor, we will take immediate steps to delete that information. In the event that personal data of a child under the age of 18 in your care is disclosed us, you hereby consent to the processing of the child's Personal Data and accept and agree to be bound by this Policy on behalf of such child. We will close any accounts used exclusively by such children and will remove and/or delete any Personal Data we believe was submitted without parental consent by any child under the age of 18.
  6. [6] DISCLOSURE OF INFORMATION
    1. We may from time to time need to share your Personal Data with various parties in other for us to provide our Services to you. These parties include:
      1. (a)With other Users: After registering, certain details from your profile, such as, but not limited to, your name, gender, and other activity-related information, will be visible to all Users on the Platform. This includes any photos you upload, Post details, ratings and reviews, and any additional information you opt to include in your profile or Post. Your data will also be shared with other Users when you send messages or otherwise engage with them. Please note that when you publish or share information, it is done at your own risk. If you share personal details with other Users, they will have access to that data as separate controllers. Although our Terms of Service require Users to keep shared information confidential, we cannot guarantee compliance by all Users, and it is your responsibility to ensure others uphold your privacy expectations. When you file a report or complaint about another User, we may need to share some of your personal information to address the matter or to comply with relevant legal requirements.
      2. (b)With Users with whom you interact: We share both personal and Post-related information to assist in facilitating interactions between Users. This sharing is kept within necessary limits and aims to enhance the services offered by Users and improve your overall experience on the Platform.
      3. (c)With Third Parties that provide Service to us: We share personal information with Service Providers who assist us in operating the Platform, managing your account, and delivering additional services and solutions for business purposes. These include, among others, Data enrichment services, hosting services, fraud detection and prevention services, IT SaaS services, CRM systems, legal and financial advisors and technical consultants, communication systems, data and cybersecurity services, web analytics and performance tools, billing and payment processors and vendors, mailing systems, session recording, data optimization and marketing services, translation tools and community management services.
      4. (d)Disclosure and Transfer of Personal Data: All data collected and held by us will be kept confidential. However, please note that we may from time to time as may be required for the purposes or Services, disclose and transfer such information to the Company's group of companies, advisers, agents, contractors, third party service providers, regulatory authorities and/ or government agencies (whether within or outside Malaysia). In the event that your Personal Data is transferred and/or stored at a place outside Malaysia, the handling of Personal Data shall be in accordance with the data protection policies, laws and regulations enforced in such jurisdiction. However, if the Personal Data is disclosed or transferred to other countries which does not have the same or comparable data protection laws as Malaysia, we will take reasonable measures to ensure that such Personal Data has an adequate and at minimum, an equivalent level of protection as it does in Malaysia. Such Personal Data is protected both online and offline
  7. [7] DATA SECURITY
    1. (a)We implement a variety of security measures, including physical, procedural, and technological safeguards, to protect your personal information from unauthorized access or exposure. These measures may include encryption, secure passwords, and physical security protocols. Additionally, User's Personal Data are contained behind secured networks and is only accessible by a limited number of employees who have special access rights to such systems. However, no security system is entirely infallible, and although we will do our best to protect your personal information, we cannot guarantee that your personal information or communications will be entirely secure or immune to unauthorized access, disclosure, or use. To enhance your security, we recommend taking precautions, such as logging out after using shared devices, choosing strong passwords, keeping your login credentials confidential, and avoiding the reuse of passwords across different sites. We are not liable for any unauthorized access to your information, nor for any loss, theft, or compromise of your password, or for any actions taken using your account due to unauthorized password activity.
    2. (b)Third parties may unlawfully intercept or access personal data transmitted to or contained on the site, technologies may malfunction or not work as anticipated, or someone might access, abuse or misuse information through no fault of ours. We will nevertheless deploy reasonable security arrangements to protect your personal data as required by the Privacy Laws; however there can inevitably be no guarantee of absolute security such as but not limited to when unauthorized disclosure arises from malicious and sophisticated hacking by malcontents through no fault of ours.
    3. (c)If we have reason to believe that a Personal Data breach has occurred, including any breach, loss, misuse or unauthorised access of personal data, we will, as soon as practicable, inform the Personal Data Protection Commissioner within 72-hours of our knowledge of such breach. If the Personal Data breach causes or is likely to cause any significant harm to you, you will be notified promptly of the same.
  8. [8] YOUR RIGHTS
    1. (a)Withdrawing Consent
      1. You may withdraw your consent for the collection, use and/or disclosure and/or request deletion of your Personal Data in our possession or under our control by sending us an email at support@mycleanerhub.my or by contacting us via WhatsApp at +60 10 882 9821, and we will process such requests in accordance with this Privacy Policy and our obligations under applicable privacy Laws. However, your withdrawal of consent may mean that we will not be able to continue providing the Services to you and we may need to terminate your existing relationship you have with us.
    2. (b)Requesting Access to or Correction of Personal Data
      1. [(i)]You can update or delete certain personal information by logging into the Platform and accessing your profile settings. It is your responsibility to keep your account details accurate and up to date. If you request account deletion, we will remove your profile from public view within a reasonable timeframe. If you do not have an account with us, you may request to access and/or correct your personal data currently in our possession or control by submitting a written request to us. We will need enough information from you in order to ascertain your identity as well as the nature of your request so as to be able to deal with your request. Hence, please submit your written request by sending an email at support@mycleanerhub.my or contacting us via WhatsApp at +60 10 882 9821. We may charge you a reasonable fee for the handling and processing of your requests to access your personal data. If we choose to charge, we will provide you with a written estimate of the fee we will be charging. Please note that we are not required to respond to or deal with your access request unless you have agreed to pay the fee. We reserve the right to refuse to correct your personal data in accordance with the provisions as set out in Privacy Laws, where they require and/or entitle an organization to refuse to correct personal data in stated circumstances.
      2. [(ii)]We may retain certain information from deactivated or deleted accounts to prevent fraud, comply with legal obligations, resolve disputes, recover any outstanding fees, assist with investigations, troubleshoot issues, enforce our Terms of Service, or for other purposes permitted by law that we consider necessary. After your account is deleted or deactivated, we are not responsible for retaining any data related to your account.
      3. [(iii)]We may occasionally send you emails. You can unsubscribe from promotional messages by following the instructions provided in those emails. Even if you choose to opt out of marketing communications, we may still contact you regarding your account or any services you have used or requested from us, wherever reasonably necessary so for us.
    3. (c)Porting of Personal Data to another Data Controller
      1. You also may, at any time, request to have your Personal Data ported to another data controller by submitting such request(s) via email at support@mycleanerhub.my or via WhatsApp at +60 10 882 9821. We shall consider such requests and make such arrangements as reasonably necessary and in-line with standard industry practices.
  9. [9] COOKIES
    1. (a)We or our authorized service providers and advertising partners may from time to time use "cookies" or other features to allow us or third parties to collect or share information in connection with your use of our Services or Platform. These features help us improve our Platform and the Services we offer, help us offer new services and features, and/or enable us and our advertising partners to serve more relevant content to you, including through remarketing. "Cookies" are identifiers that are stored on your computer or mobile device that record data about the computer or mobile device, how and when the Services or Platform are used or visited, by how many people and other activity within our Platform. We may link cookie information to personal data. Cookies also link to information regarding what web pages you have viewed. This information is used to deliver content specific to your interests, to enable our third party advertising partners to serve advertisements on sites across the internet, and to conduct data analysis and to monitor usage of the Services. Please note that while subscription purchases (such as premium plans selected by Service Providers) are processed off-platform through third-party payment providers like Stripe, certain cookie data related to these subscription activities may still be collected and used within the Platform to support user account management.
    2. (b)You may refuse the use of cookies by selecting the appropriate settings on your browser or device. However, please note that if you do this you may not be able to use the full functionality of our Platform or the Services.
  10. [10] EXTERNAL LINKS
    1. (a)Please be aware that the Platform may contain links to third-party websites. In an attempt to provide you with increased value, we may choose various third party websites to link to, and frame within the Platform. We may also participate in co-branding and other relationships to offer e- commerce and other services and features to our visitors. These linked sites have separate and independent privacy policies as well as security arrangements. Even if the third party is affiliated with us, we have no control over these linked sites, each of which has separate privacy and data collection practices independent of us. Data collected by our co-brand partners or third party web sites (even if offered on or through our Platform) may not be received by us.
    2. (b)If you choose to visit any of these third-party sites, the data you provide and how it is used by those sites is not governed by this Privacy Policy and is not under our control. WE DO NOT GUARANTEE THE SECURITY OF PERSONAL DATA AND/OR OTHER INFORMATION THAT YOU PROVIDE ON THIRD PARTY SITES. We therefore have no responsibility or liability for the content, security arrangements (or lack thereof) and activities of these linked sites. These linked sites are only for your convenience and you therefore access them at your own risk. Nonetheless, we seek to protect the integrity of our Platform and the links placed upon each of them and therefore welcome any feedback about these linked sites (including, without limitation, if a specific link does not work).
    3. (c)We encourage you to review the privacy policies of any third-party sites you visit. This Policy only applies to personal information collected through our Platform. If you upload content, including personal information, to a social media platform and tag our Platform, your submission will be governed by that social media platform's terms of use and privacy policy. We do not control or review the adequacy of these external terms and policies, so it is important to review them before sharing any personal information.
  11. [11] CHANGES TO THIS POLICY
    1. We may update this Privacy Policy from time to time. Changes will be posted on this page with a new "Last Updated" date. Changes to this Policy are effective as of the stated "Last Updated" date. It is your responsibility to review the Privacy Policy regularly. Your continued use of the Apps, Websites or Services, or continuing to communicate or engage with us following the modifications, updates or amendments to this Policy, whether or not reviewed by you, shall constitute your agreement to be bound by such amendments.

  13. [13] GOVERNING LANGUAGE
    1. This Privacy Policy may be translated into multiple languages. In the event of any inconsistency, ambiguity or conflict between the English version and a translated version, the English version shall prevail.
